WILLS AND PROBATE

Jerry M. Miniard has prepared wills and trusts for hundreds of clients over the years.  Estate planning documents range from the simple to the complex.  He believes that every individual should have a will.  He helps accomplish this goal by competitively pricing his fee for a simple will.   He has represented numerous estates throughout his decades of practice, including transferring assets via a petition to dispense with administration of the estate to a full- blown estate requiring a federal income tax return to be filed.

His services include, but are not limited to:

  • Wills
  • Living wills
  • Power of attorney
  • Estate administration

It is of the utmost importance for parents of minor children to designate a guardian in their will so that if both parents die while the child(ren) are under the age of majority (18) they will have a say as to who is put in charge of nurturing their child(ren).  When nominating a guardian in a will, the district court will know the desire of the parents and probably appoint the individual nominated as guardian to care for and raise the minor child(ren).

Jerry M. Miniard has also engaged in litigation on behalf of a beneficiary to force an accounting by an executor or trustee.   The typical situation in these cases involves a trustee who fails to disclose information to the beneficiaries under the trust or fails to properly distribute assets in accordance with the terms of the trust.
